Q&A part 1

Lindell Kay | Cesar Laurean, HOME PAGE | Tuesday, April 15th, 2008

Capt. Sutherland, were Luminol tests conducted on the driveway at 103 Meadow Trail on Jan. 11 or thereafter?

  1. Can you please verify that there were nails and staples in the firepit with Maria’s body? Investigators think those nails came from the fence, right? Also, I went by the house the other day and it looked like more of the fence was missing. Any idea on that? Hope you answer.

    Comment by Izzi — April 15, 2008 @ 3:22 am

  2. The Laureans had sold a table from the Lejuene Yard Sale site. I wonder why it was not luminoled for traces of blood?

  3. Can you find about the shoe that was found while Greta was there. Whos was it and can it be used? Was there dna on it or in it?

    Comment by de — April 15, 2008 @ 6:24 am

  4. Has LE determined if the purpose of the bus ticket to El Paso, was because Maria felt she needed to get away from everyone (Lauterbachs, Cesar and USMC) to sort out a plan for once Gabriel was born? Was the El Paso destination intentional or does LE believe it was her intention to travel just a portion of the way to El Paso? If yes, where does LE believe the actual destination was intended?

    Comment by KPH — April 15, 2008 @ 7:26 am

  5. When Maria was first reported missing, did the OCSD have contact with one or both of Maria’s biological parents to determine is she had recent contact with one or both of them? If no, does your office know if NCIS had similar contact?

    Comment by KPH — April 15, 2008 @ 7:30 am

  6. Who is the 2nd person at the ATM on Dec 24th that appears to be standing behind the one (Cesar) wiping the camera lens? Has this person been apprehended?

    Comment by LT — April 15, 2008 @ 8:05 am

  7. How is Christina not considered a suspect when she was selling items from the home.Would not let the buyer of the table come to her home and it was her and cesar BOTh that hauled the table and chairs to a bank parking lot?

    Comment by KDB — April 15, 2008 @ 8:20 am

  8. KDB, sounds awfully fishy to me!

    Comment by Tam534 — April 15, 2008 @ 8:29 am

  9. Captain Sutherland, why after three months, all of a sudden it seems that law enforcement and the DA are trying to polish Christina Laurean’s image? Very unusual. Since DA Hudson gave his own rendition of Christina’s woes and specifically used the words “cheating on her” is he confirming that Maria and Cesar had a relationship? Is the reason Christina is not a suspect is because LE have no exact time of death and cannot refute her words when she says she wasn’t in the home when this happened? Do you think that is subject to change should additional information come to light, possibly in the coming months?

    Comment by Drake Garrett — April 15, 2008 @ 8:45 am

  10. How is Christina still considered a witness when she had been communicating with Cesar via computer, but did not tell the authorities? Is LE 100% sure that it was Maria that bought the bus ticket?

    Comment by LTH — April 15, 2008 @ 8:46 am

  11. Also, even if Christina had to work on the 15th as she had told her mother, there still would have been time for her to have helped in the cleanup. No way Cesar could have done all of that before she got home at 7:00 PM, is there? Also, she has told you that Cesar left at 4:00 AM, yet someone from the Laurean home logged on and read the article and documents from jdnews. Could she really be telling you the truth? Could she have also used computers from work to communicate with Cesar? Have those been checked? Have her friends computers been checked if she spent a lot of time with one or more of them?

    Comment by Tam534 — April 15, 2008 @ 8:52 am

  12. Did someone who knows Cesar watch the ATM footage from 24DEC2007 and identify him?
Does the video show evidence of a second person at the ATM 24DEC2007?

    Comment by Lefty — April 15, 2008 @ 8:53 am

  13. How can Christina be a good witness since she omitted/neglected to tell you that she was communicating with an International fugitive/USMC Deserter? Isn’t withholding information the same as lying?

    (I wish I were a defense attorney)

    Comment by Tam534 — April 15, 2008 @ 8:57 am

  14. Captain Sutherland, have any of you maybe thought that Cesar and Christina may have tried to ‘take’ Maria’s baby and maybe used that kitchen table they sold? That might would account for the baby’s hand seeming to be severed, wouldn’t it?

    Comment by VeryCurious — April 15, 2008 @ 9:06 am

  15. Also is there a definite time of death for Maria?

    Comment by KDB — April 15, 2008 @ 9:13 am

  16. Captain Sutherland, Is the reason for all the PR moves last week done for Christina Laurean because all of you know when it comes to trial that she will carry heavy baggage of her own? I admit when I saw this going on it gave me flashbacks of Gloria Alred and Amber Frey, yet Ms. Alred was her attorney and it was not done by any law enforcement or the DA.

    Comment by Drake Garrett — April 15, 2008 @ 9:15 am

  17. Also, are you sure that Christina is really heartbroken because she ‘loves’ Cesar, OR is it because she is scared knowing that she helped? Could the diary have been written to leave behind when/if she left to join Cesar for her parents and LE to think “I loved him so much I could not help myself’?

    Comment by VeryCurious — April 15, 2008 @ 9:18 am

  18. I want to take a moment to add; I know these questions are very tiring. You owe us nothing.Everyone here wants to see justice done without jeapardising the case. Its just there are too many inconceivable facts that dont add up.Please be patient with all of us following the case and tell us what you can. I think this case is one that nobody will ever forget .I know I wont. thanks.

    Comment by KDB — April 15, 2008 @ 9:22 am

  19. We have not heard anything at all about the truck since it was recovered. I am a practicalist, I hope Mr. Laurean Sr’s vehicle was not wrecked by getting it onto the towtruck flatbed without the ignition key. I have had a lot of cars taken away on a flatbed over the years and the driver always wants the iginition key. Let’s hope the senior Laureans still have a servicable vehicle. The truck was registered to the dad, so I read in the beginning. Could it all have been done elsewhere and taken to Meadow Trail? Also, what if Maria was going wild whacking about with a blunt instrument and whacked Cesar a few times so he lost his cool? Just thinking….

    Comment by justice4all — April 15, 2008 @ 9:25 am

  20. Just a thought on the blood. WAS the blood Maria’s. Sounds weird, I know, but some people will butcher a deer in their garage. I am not saying he did butcher a deer, I am just wondering if the blood was identified as Maria’s?

    Comment by justice4all — April 15, 2008 @ 9:28 am

  21. This case would be wonderfully resolved if we could get honest confessions anyone and everyone involved. I am not sure we will get that, though, and although this is a very emotionally charged case, the plain fact is that someone has taken the life of another, and in our society that is not permitted. There may be many REASONS for this crime, but there is no EXCUSE. We shall need to keep very cool heads as this progresses so we can sort the chaff from the wheat. I think, also, that both Cesar’s and Maria’s careers were ruined from the time the rape allegation was filed. She for saying there was consensual activity, and he because mud sticks. He denied all contact of a sexual nature, friendly or otherwise. It is hard to prove that there might have been an unfriendly encounter when you have said there was a prior consensual encounter.

    Comment by justice4all — April 15, 2008 @ 9:34 am

  22. KDB, in retrospect one wonders why they were selling things, but it is not illegal to change funiture. It was around Christmas and maybe the Christmas present was new furniture. Another thing, do you think he was planning to deploy? It could have been that they were lightening the load to clear out the house a bit. It really did look fairly well furnished. I saw what looked like two couches, and the garage just stuffed full of things, like anyone’s garage could be. Lawn tractor, tubs of storage and so forth.

    Comment by justice4all — April 15, 2008 @ 9:38 am

  23. You know, we might all be being buffaloed. When Cesar was asked whether he killed Maria, he SIDESTEPPED completely (led everyone on a wild goose chase) by saying, “I loved her.” His words carried the day and we didn’t comment on the original question. He was correct, though, in not answering it. That is something he really needs to talk with his lawyer about. As far as Christina being devastated. I am certain she and her entire family ARE devastated. What an emotional strain. She does owe responsibility to her spouse and just corresponding is not illegal, but I think we need to wait and see a little more about said corresponding before we can make any judgement.

    Comment by justice4all — April 15, 2008 @ 9:45 am

  24. justice4all, you need your own column or place on here. Where do you get off saying you think WE need to wait before making any judgement. You are pretty abrasive and know it all.

    Comment by VeryCurious — April 15, 2008 @ 9:54 am

  25. Sorry, VeryCurious, I did not mean to sound that way. We have a big family, and WE is our usual word. I am just very uncomfortable about what we DO know, because I think there is a lot going on under the surface.

    Comment by justice4all — April 15, 2008 @ 9:58 am

  26. No problem. It is that that the ‘we’ you use does sound as if you are trying to direct other posters. Sorry I jumped. It was rude of me.

    Comment by VeryCurious — April 15, 2008 @ 10:02 am

  27. Thanks VeryCurious. Not rude, just wanting to get to the bottom of it all.

    Comment by justice4all — April 15, 2008 @ 10:03 am

  28. Captain Sutherland, I honestly believe that Cpl Laurean thinks he will be tried on no evidence and it will be mostly circumstantial due to his notes placing him and Maria there. I feel there is vast evidence you have uncovered for the after the fact crimes such as the clean up, cover up and fraud but do you have solid forensic evidence connecting him directly to the actual murder, itself, since all of this happened behind closed doors and the time of death is unknown? I believed Cpl. Laurean’s words of “I loved her” and his one word of “Proof” was profound. I believe Cpl. Laurean knows things you have not uncovered yet, do you believe the same? Are you hoping that Cpl. Laurean comes back and speaks with law enforcement to clear up some matters that have remained unclear in your investigation?

    Comment by Drake Garrett — April 15, 2008 @ 10:25 am

  29. On AMW when the famous ‘notes’ were shown on the table, they appeared to be typed and the signature was not scrawled as is Cesar’s usual writing. Am I right? Freeze frame that part, please, and maybe you can see what I mean.
Did Cesar handwrite or sign all of the notes?

    Comment by Rae — April 15, 2008 @ 11:17 am

  30. Is Christina’s little poodle type dog still safe and being well cared for? Can you tell me if it is a boy or a girl and the name? Thank you.

    Comment by Lily — April 15, 2008 @ 1:38 pm

  31. There are posters saying Maria was mentally ill. It is being said she was bipolar and treated in the MC. It is also being said she was a compulsive liar. This is coming from what her mother or uncle said and nothing more. Even though this has nothing to do with the murder case, I hate seeing Maria being bashed. Could you confirm or deny any of these rumors? Thank you.

    Comment by Lily — April 15, 2008 @ 3:37 pm

  32. There appears to be some misunderstanding about what this Q&A thread would be used for from what I’m seeing posted here. They are for Sutherland to answer. Captain Sutherland is busy these days and I expect his workload to increase even more.

If you are looking for the advocates, call an advocacy group, if you are looking for a fight, go to the local play pen and have at it, if you are looking for a pet, go to the humane society, if you are looking for interaction, use another thread. Some of these questions are answered in his linked documents. The questions are supposed to be set up in a manner that it will be easy to answer.

Let’s try to keep this thread set up as it was intended by Lindell Kay as an easy access for Captain Sutherland to give us some feedback on questions.

I urge you to keep that in mind when posting questions if you would like Captain Sutherland to continue answering for us. Let’s make it easy for him so we get answers and not the old standard blow off.

  33. My theory is that Christina Laurean is involved in this up to her ears. I think Cesar is attempting to protect the Mother of his daughter. I don’t know if the baby Maria was carrying was Cesars but I’ll bet Christina thought it was, that is why I think Christina is involved. I hope I’m wrong about this for the sake of their daughter. I would be awful for that child to loose both parents but it was worse for Maria and her little boy to loose their lives.

  39. I ran into Capt. Sutherland downtown and asked whether he had seen this page and he said he had, but said he thought I had asked for serious questions. While I enjoy reading every comment y’all put on here, this thread was supposed to be for legitimate questions. Here is a legitimate question: - de Says: capt sutherland Is christina left handed or right handed? Same for cesar? - Not so good question: My theory is that Christina Laurean is involved in this up to her ears. - Whoa! Five sentences and no question marks. Plus I said no theories and the commnet starts with, “My theory is…” To get him to answer the good questions, we have to stop asking the bad. I am starting a “My theory is…” post. Please feel free to put it there and we can compare notes. But please reserve this thread for questions of fact.

  40. Was Maria forced or lured to Laurean’s home on December 14th?

If Maria wasn’t forced or lured to Laurean’s home, was there any communication (cell phone, email, text messaging) just on December 14th or had there been communication prior to that date?

    Comment by Phyllis — April 15, 2008 @ 9:35 pm

  41. My theory is … when christina went to the party, maria came over to their house because she and cesar made plans to meet each other in texas. When cesar didnt show up christina came home and found maria there and hit her on the left side of her head and maria ran through the house and into the garage and thats where she was cornered and got killed. Thats why I asked if she was left handed because she hit her from behind.

  43. I will try to answer the questions in order. If I skip a question, I can’t talk about it or I have already addressed it. I appreciate all of the questions and the interest in the case. I will do my best to visit this thread a couple of times a week. Also, if some of my answers seem short, they are not a reflection of the question or the person asking the question. They are a reflection of the amount of questions that I am trying to respond to.

Luminol is a chemical test that is very sensitive to the presence of blood. It is used to try to locate blood where visible blood is not present. The SBI performed the luminol testing in this case for us. They used these tests where necessary to discover evidence and to try to recreate some portions of the crime scene. After the processing of the house, I had a chance to speak to the CSI guys from our Office and we discussed some theories as to what occurred, where it occurred, and then what happened next. The luminol testing was used to prove/disprove those theories and to locate blood evidence not visible to the eye. Evidence developed after the processing of the house validated one of the theories proposed by the CSI guys. We feel confident that we know what happened. The SBI performed the tests we needed to help us to arrive at the facts. That is as specific as I will be.

The Sheriff said that there were nails/staples in the grave and that they appeared to be from a burned section of the fence. No idea whether more fence is missing or why.

We feel comfortable that we know who the shoe belongs to and that it will be available to prosecutors if they decide to use it at the trial. It appears to have evidentiary value.

The El Paso question. There are some answers in this case that could only come from Cesar or Maria. Maria, sadly, is no longer with us, and we don’t know if Cesar will choose to answer some of the other questions that we have.

I am not sure at what point OCSD/NCIS had contact with Maria’s biological parents. The homicide investigators would know if they had information material to the case and make contact with them at the appropriate time. I can not answer for NCIS.

We have reviewed the video with our forensic tools and do not think that there is more than one person.

KDB. I am sorry; I don’t understand the context of the question about the table. Ask it again next round and expound a little.

There are a lot of people who believe with all of their hearts that Christina is guilty. I won’t begin to try to change your minds. Our Office has access to all of the info in the homicide case and we don’t believe that she had any part in the homicide. There is no cover up; there is no “deal” in exchange for her testimony. We have access to info on Cesar, Christina, and Maria for the time surrounding Maria’s death and our homicide guys drew a warrant and testified before a Grand Jury that they had probable cause that Cesar killed Maria, and that is why we were seeking to apprehend him. There is no way that we could let people look at the case file before trial, but if we were able to fully disclose our info to the public it would change people’s minds. But, our first duty is to proceed with the trial of Cesar and not to reveal all the info we have collected. If we received info tomorrow that implicated anyone in this case, we would discuss that info with the DA’s Office and recommend charges based on the info.

The DA answered the question about the law regarding communicating with a fugitive.

We are very confident that Maria bought the ticket.

Some times given in this case are approximations. Like “he left around 4:00am”. Other times are more concrete based on the supporting evidence.

We feel that we have identified Cesar from the ATM footage to the point that we could prove our case to a jury beyond reasonable doubt. I have not seen evidence of a second person.

If you are referring to Christina being a witness in the future (at trial) there is no way for me to speculate on that. If you are referring to the present, any witness, in any case, can provide information that is useful to an investigation even if they do not appear to be 100% “on board” with the investigation.

We believe that the Pathologists have explained and accounted for the condition of the bodies and we will rely on their examinations, opinions, and testimony as we move toward trial. There may be other “theories” that seem to be consistent, but the ME’s opinions are the answers to our questions.

No exact time of death, just time parameters.

Some of the remarks at the Conference were to try to answer questions that have been asked of our Office and some were because of information that is set to be unsealed.

I can not begin to speak for Christina’s emotions. I can only imagine that she has had to deal with enormous burdens in this situation and she is also suddenly a single parent.

    The truck is still functional.

The SBI Lab will perform most of the forensic testing and make their experts available to testify at trial.

In any investigation, we would like to talk to the persons involved to get the story from them. In this case, we believe that we can prove our case beyond reasonable doubt. The evidence to support that belief will be introduced at trial.

The notes brought to our Office were handwritten.

The dog is fine, to the best of my knowledge. No idea on the gender or the name. (Can neither confirm nor deny the info posted in this thread on the dog and OCAS)

I choose not to repeat any info, but the Incident Report by my Office is public record and there is a link on this web site to some info released by the Marine Corps.

I can check with the homicide guys on the rh/lh question. There is no evidence to support that anyone killed Maria other than Cesar. That is why the Grand Jury found probable cause based on what we presented to them and indicted him.

Now, allow me to babble a moment. I can not begin to tell you what a great job the FBI, NCIS, the Marshals, and hundreds of state and local entities did in supporting us on this case. It is mind boggling to think of all of the leads that we have investigated in the last 90 days. We could have never reached the point we are at without support from these great law enforcement entities. The resources and intellect that are represented in these agencies and the way we were able to work together despite having different administrations and polices should make people proud of the LEO’s that they have and that fact that our LEO’s are the finest in the world. I am deeply saddened that I had to investigate the death of Maria, I am extremely proud to have worked with these excellent men and women across the country.

  45. Thank you for your answers. I see you are excluding Christina as being involved in the murder but did not mention that she may have had knowledge or covered up the crime.

In your next round of answers would you please answer if you can whether Laurean was aware before 12-14-07 that Maria was saying that Gabriel wasn’t his or that she was trying to drop the allegations per what her uncle told the media?

I would think the GJ would indict based on Maria’s body being found in his own backyard, his notes, blood in home and him fleeing. That is a long way from proving directly that he and he alone did this crime unless you have forensics that confirms that and I do believe the jury will closely scrutinize this case much more closely than some think they will. While you have sympathy for Christina most that I have seen, do not and certainly find her less than honorable. By secretively communicating with the very fugitive everyone was searching for including her own employer shows she only becomes cooperative after she has been caught when it is to her advantage.

  46. Back to Laurean’s dog, Lily, the cute little poodle, I saw an interview on Animal Planet with the District Attorney Dewey Hudson and he said Lily’s Veterinarian records indicated that she was incontinent and lethargic during the entire month of January and appeared to loose its will to live. Would this newly disclosed behavior indicate trouble in the Meadow Trail home?

  49. Okay. Here is the deal. I have opened a new thread called Q&A part two. Please ask questions for Sutherland there. If there is anything y’all want to discuss here, feel free to, but I’m going to start the second round of questions on a new thread. There is one question I can answer here. The one about why more fence seems missing now, Mike and I were in the neighborhood today and saw that a portion of the fence fell down. It is laying where it fell in the yard of the people who were on TV every day back in January with a new story. The roadblock versus fluke thing I feel comfortable to say was a combo of the cops closing in on him and his being in the wrong place at the wrong time. The easiest way to look at it is like this: Let’s say you are hiding out in Onslow County and the authorities have eliminated your resources to the point that you are living in a shack in the country out by Richlands. You have been hounded everywhere and have been limited in where you can go. The county and state authorities are zeroing in on you. Meanwhile, the Richlands police are conducting an unrelated investigation that you stumble upon walking into town to buy some food (or use an Internet cafe). They detain you and learn who you are. Now, is that a fluke? I don’t think it is. Like the sheriff said, investigators made it hard on Laurean. The fact that his family would not help made it hard on Laurean. U.S. and Mexican cops were all over the place he was caught looking for him. I feel confident that had he not been stopped Thursday in the street, he was only a few days from capture. When I told the D.A. and Sheriff’s Department earlier in the day on Thursday that the newspaper was going to run with the story on the new search warrants they did not ask me to wait a month or two months, they asked me to wait until Monday. I would say that was a pretty good indication that they thought they would have him by then.
